Terms and Conditions
Welcome to Ziada, an online tutoring platform operated by Techture Limited. By accessing or using the Ziada platform, you acknowledge that you have read, understood, and agreed to be bound by these Terms and Conditions. This document serves as a legal agreement between you and Ziada and outlines the rights, responsibilities, and obligations of all parties using the platform. If you do not agree with these terms, you must discontinue using our services.
1. Introduction
Ziada is a Kenyan-based online platform designed to connect tutors with students of all levels, from primary school to university, and to facilitate general remedial learning. Through this platform, students can access high-quality education from verified tutors, and tutors have the opportunity to earn income by sharing their knowledge. Ziada also features an affiliate program that allows users to earn commissions by promoting the platform.
These Terms and Conditions govern the use of all Ziada services, including the website, mobile application, and any associated services. The terms aim to ensure a safe, respectful, and effective environment for learning, teaching, and earning.
2. Definitions
To avoid ambiguity, the following definitions apply to this document:
3. Eligibility
To use Ziada, all users must meet certain eligibility criteria. Individuals must be at least 18 years old to register an account independently. Students below this age require explicit consent from a parent or guardian, who must oversee the account and ensure that all interactions comply with these terms.
Tutors must provide proof of qualifications, including academic certificates and a valid Kenyan National ID or Passport. This ensures the credibility and trustworthiness of tutors on the platform. Affiliates must also be at least 18 years old and provide accurate payment details to participate in the program.
By registering, you warrant that the information provided during sign-up is accurate, truthful, and up-to-date. Misrepresentation of any information, including age, qualifications, or identity, will result in immediate suspension or termination of your account.
4. Registration and Account Management
To access Ziada’s full range of services, users are required to create an account. Registration involves providing personal information, including your full name, a valid email address, and a phone number. Additional documentation, such as a clear copy of your Kenyan National ID or Passport, is required for tutors and affiliates.
Upon successful registration, users are responsible for maintaining the confidentiality of their account credentials. Sharing your account details with others is strictly prohibited. If you suspect unauthorized access to your account, you must notify Ziada immediately. Failure to do so may result in the loss of funds or data, for which Ziada will not be held liable.
Ziada reserves the right to review and verify all submitted documents. This verification process helps maintain the integrity of the platform and ensures the safety of all users.
5. Tutor Responsibilities
Tutors play a central role in the Ziada ecosystem, and their responsibilities are defined to maintain high standards of teaching and professionalism. As a tutor, you must provide accurate and verifiable credentials, including your academic qualifications and identification. These documents will be subject to review by Ziada before your profile is activated.
Tutors are expected to conduct themselves professionally at all times. This includes preparing adequately for lessons, delivering them on time, and maintaining respectful communication with students and their guardians. Any form of harassment, discrimination, or exploitation will lead to immediate account suspension and possible legal action.
All interactions between tutors and students must occur within the Ziada platform. Off-platform arrangements for lessons or payments are prohibited and may result in account termination. Tutors are also responsible for ensuring compliance with applicable tax laws and must declare their earnings as required.
At Ziada, we are dedicated to building a professional and thriving community of educators who provide high-quality learning experiences to students. To uphold this standard, we require all tutors to pay a one-time, non-refundable registration fee of KES 500. This fee serves several important purposes:
1. Ensuring Professional Commitment: The registration fee helps distinguish committed and serious tutors from casual applicants. By making this small investment, tutors demonstrate their dedication to offering quality education and their seriousness about leveraging the platform for professional growth.
2. Supporting Platform Services: The fee enables us to cover essential administrative processes, including verifying credentials, maintaining tutor profiles, and ensuring that Ziada remains a secure and seamless platform for both tutors and students.
We understand that starting out as a tutor might feel like an investment, but with Ziada’s extensive student base and fair policies, your first lesson could cover this registration cost and more. By joining Ziada, you’re stepping into a vibrant ecosystem where your skills are valued, and opportunities to grow your teaching career are abundant.
6. Student Responsibilities
Students and their guardians are responsible for ensuring that lessons are booked and attended as scheduled. When booking lessons, students must provide accurate information and make timely payments. Canceling a lesson requires at least 24 hours’ notice; otherwise, the full lesson fee may be forfeited.
Students are expected to participate actively and respectfully during lessons. Disruptive or inappropriate behavior toward tutors or other users will not be tolerated. Additionally, students or their guardians must ensure that their account information remains accurate and up-to-date, including payment details.
Ziada provides a structured refund policy for canceled or missed lessons. Refunds will only be processed if cancellations are made in accordance with the platform's guidelines.
7. Fees and Payments
Ziada operates on a transparent fee structure. Tutors set their hourly rates, which are clearly displayed on their profiles. The platform charges a 30% commission on all tutor earnings to cover operational costs and maintain the platform.
Payments for lessons must be made through secure methods integrated into the platform, such as Mpesa Pay. Students are required to have sufficient funds before booking a lesson. Tutors receive their earnings (minus Ziada’s commission) upon withdrawal requests, provided their account meets the payout threshold.
Affiliates earn 2% commission on all transactions of every referred user. These earnings are paid upon withdrawal request, with a minimum payout threshold of KES. Affiliates must ensure their payment details are accurate to avoid delays.
8. Affiliate Program
Ziada's affiliate program offers a unique opportunity for users to earn passive income by promoting the platform. Affiliates receive a unique referral link, which they can share with potential users. When a referred user makes their first purchase, the affiliate earns a 10% commission.
Affiliates are prohibited from using unethical marketing practices, such as spamming or making false claims about the platform. Violations of these rules will result in removal from the program and forfeiture of unpaid commissions.
9. Code of Conduct
Ziada strives to create a safe and respectful environment for all users. This requires strict adherence to a code of conduct that emphasizes respect, integrity, and professionalism. Users are prohibited from engaging in abusive, discriminatory, or harmful behavior.
Additionally, the sharing of inappropriate or unlawful content, attempts to hack the platform, or other actions that compromise the safety and functionality of Ziada will result in immediate termination and potential legal consequences.
10. Intellectual Property
All content and materials available on Ziada, including text, images, logos, and software, are the exclusive property of Techture Limited. Users are prohibited from reproducing, distributing, or modifying these materials without explicit permission.
Content created by tutors for lessons remains their intellectual property. However, Ziada reserves the right to remove any content that violates these Terms and Conditions.
11. Privacy Policy
Ziada is committed to protecting your privacy. Personal information collected during registration is used solely for verification and service delivery. This information is stored securely and will not be shared with third parties without user consent, except as required by law.
12. Governing Law and Amendments
These Terms and Conditions are governed by the laws of Kenya. Ziada reserves the right to amend these terms at any time. Users will be notified of significant changes, and continued use of the platform constitutes acceptance of the updated terms.
